The terms governing access to and use of tpsproduction.com. Please read them: they set out what this website is, what it is not, and the limits that apply to the information it contains.

1. Website provider
The website tpsproduction.com is operated by TPS – Technology Projects & Software Production, hereinafter “TPS”. The provider’s identification details are set out below, in accordance with the information duties laid down by Italian Legislative Decree 70/2003, implementing Directive 2000/31/EC on information society services.

2. Scope and acceptance
These Terms govern access to and use of the Website. By accessing the Website or using its content, the User confirms that they have read these Terms and accept them in full. Anyone who does not accept them is asked not to use the Website.
These Terms apply to the Website only. They do not govern the supply of TPS platforms and services, which is regulated by separate contractual agreements entered into with each customer and, where applicable, by the specific terms of use of each platform.
3. Definitions
- Website: the website tpsproduction.com in all its language versions, including the pages and sub-pages that make it up.
- User: any person who accesses the Website or uses its content.
- Content: text, images, trade marks, logos, graphics, documents and any other material published on the Website.
- Platforms: the software solutions developed by TPS and described on the Website, including AllergyMonitor, AllergyCard, AllergyPlan and ScoradCard.
4. Who this website is for
The Website serves an informational and corporate purpose and is addressed primarily to healthcare professionals, healthcare providers, research bodies and companies operating in the diagnostics and pharmaceutical sectors. It is not designed as a source of health information for the general public, nor as a patient support channel.
The Website does not allow products or services to be purchased online and does not collect patient clinical data. The only processing of personal data connected with browsing is the one described in section 9.
5. Products and regulatory status
The Platforms described on the Website have different regulatory statuses. The information published here is descriptive and does not replace the technical documentation, the instructions for use and the information supplied with each product, which are the only binding reference.
AllergyPlan is currently undergoing CE certification as a class IIa medical device under Regulation (EU) 2017/745. Until the conformity assessment procedure is complete, the product does not bear the CE mark and may not be placed on the market or put into service as a medical device. The information published on the Website is therefore purely descriptive and does not constitute a commercial offer of the device.
In line with Article 7 of Regulation (EU) 2017/745, TPS does not ascribe to its solutions any function, performance or intended purpose that is not supported by the relevant technical documentation and, where required, by the clinical evaluation. Any reference to features based on artificial intelligence algorithms describes decision-support tools: they never replace the judgement of the healthcare professional, who retains full clinical responsibility.
6. No clinical advice
The Content of the Website is informational and does not constitute medical advice, a diagnostic opinion or a therapeutic recommendation. It must not be used to make a diagnosis, or to start, change or stop any treatment.
Anyone in a condition that requires medical attention should contact their doctor or the appropriate healthcare services.
7. Permitted use
The User undertakes to use the Website for lawful purposes and in a way that does not impair its operation or the rights of third parties. In particular, it is prohibited to:
- publish, transmit or distribute through the Website any content that is unlawful, defamatory, misleading or infringes the rights of others;
- use the Website for fraudulent purposes or for activities prohibited by law;
- attempt to gain unauthorised access to systems, networks or data, or to compromise their security and availability;
- carry out bulk or systematic extraction of the Content, including by automated means, without the prior written consent of TPS.
8. Intellectual property
The Content of the Website, together with the trade marks, logos, Platform names and software, belongs to TPS or to the respective rights holders and is protected by copyright and industrial property law.
Consulting, printing and downloading extracts is permitted for personal or internal professional use, provided the content is not altered and the source is acknowledged. Any other use, in particular reproduction, distribution, communication to the public or modification for commercial purposes, requires the written authorisation of TPS.
9. Personal data
Personal data collected through the Website is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national law. Information on purposes, legal bases, categories of data, retention periods and data subject rights is set out in the dedicated privacy notice.

10. Cookies and tracking
The Website uses technical cookies necessary for its operation and, subject to the User’s consent, cookies and similar technologies for statistical measurement. Consent is collected through the dedicated banner and can be withdrawn at any time from the preferences panel. The technologies used are described in detail in the notice linked from the banner.
11. Limitation of liability
TPS maintains the Content of the Website with the diligence required by its business, but does not warrant that it is at all times complete, up to date or free from inaccuracies, nor that the Website will be available without interruption or error.
To the extent permitted by applicable law, TPS is not liable for damages arising from the use of, or inability to use, the Website, except in cases of wilful misconduct or gross negligence. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for personal injury.
12. Third-party links
The Website may contain links to resources operated by third parties, including the app stores from which the mobile applications can be downloaded. Those resources are subject to the terms and notices of their respective operators. TPS exercises no control over such content and is not liable for its availability, accuracy or compliance.
13. Changes
TPS may amend, update or suspend the Website and its Content, as well as these Terms, for organisational, technical or regulatory reasons. Changes take effect when published on the Website; the date shown at the top indicates the last update. Continued use of the Website after publication constitutes acceptance of the updated version.
14. Governing law and jurisdiction
These Terms are governed by Italian law. The Courts of Rome have jurisdiction over any dispute concerning their interpretation or performance.
Where the User qualifies as a consumer under Italian Legislative Decree 206/2005 (Consumer Code), the mandatory jurisdiction of the courts of the consumer’s place of residence or elected domicile continues to apply, as do any provisions of consumer protection law that are more favourable to them.
